Background: Ph.D. from a top 40 US school, postdoc in a top 10 US school,
currently working as a senior research scientist for an US company
At the time when petition filed, 6 English 1st author papers, 2 English 2nd
author papers, a few Chinese publications, total about 40 citations, 2 oral
conference presentations, 6 posters, 2 patent applications, Review 4 times,
5 membership, a few small awards received from Ph.D. school, no media report
. 10 reference letters with 6 independent (1 oversea). The CEO of our
corporate wrote a very strong letter introducing my work, which I think
helps a lot, besides all other strong letters. One patent application was
filed together with the company while I was working as postdoc.The company
is commercializing that patent right now and I am the person who in charge
of the most of the technical work.
On the other hand, my EB1B I140 is still pending although it was received by
NSC on the same day. I hope this 140 will be proved soon so my I-485, which
was submitted last December, will be approved quickly.
I also have a few questions for help from here:
1. I got my EAD and AP based on my EB1B 485 application, but Can I use my
EAD and AP if my EB1B I140 got denied eventually? I guess my question is
whether I have to use the EAD and AP from my NIW 485 application when NIW
2. After the NIW becomes current for Chinese applicants and my EB1B 140 is
still pending for approval, can I re-link my I-485 to my NIW I-140?
